McDERMOTT AND SEIA ROUNDTABLE: UPDATE ON THE SOLAR CIRCUMVENTION PROCEEDING AND DISCUSSION OF POSSIBLE COMMENTS IN RESPONSE TO COMMERCE’S RECENT MEMO

Auxin Solar Inc. sent shockwaves through the solar industry earlier this year when it filed a petition that has since pushed the US Department of Commerce (Commerce) to consider imposing tariffs on solar panels imported from Cambodia, Malaysia, Thailand and Vietnam. On May 2, 2022, Commerce released a subsequent memorandum detailing three important aspects of its ongoing circumvention investigation and is giving interested parties until 5:00 pm EDT on May 19, 2022, to provide comments on potential certification requirements and cash deposits.
Join the Solar Energy Industry Association (SEIA) and McDermott Will & Emery’s Energy and Project Finance and International Trade teams on May 17 for a roundtable discussion that will consist of substantive arguments, best practices and other advocacy strategies for US solar developers who are preparing collective and individual responses to Commerce. The speakers will also share their professional guidance and tangible next steps for how US solar developers can best:
- Address the issues raised in the memo concerning ambiguity around wafers, which could impact the scope of the investigation
- Determine whether they have standing to submit formal comments to Commerce
- Provide clear guidance to Commerce on the critical certification process related to both certification requirements and cash deposit rates.
McDermott is currently preparing comments for a large number of US solar developers and also providing additional feedback on comments prepared by other US solar developers to ensure that they are putting their best foot forward during this critical period. SEIA and McDermott are offering to open up their playbooks to the entire industry.
